David Resnick & Associates, P.C., a New York personal injury law firm, announced that attorney Philip Monier secured a $1,925,000 settlement before trial for a 38-year-old woman who sustained catastrophic injuries in a staircase slip-and-fall accident. The incident occurred when the woman slipped on a wet and slippery staircase in her building, leading to severe physical injuries and long-term disruption to her daily life.

The law firm filed the slip-and-fall lawsuit in the Supreme Court of the State of New York, New York County. The complaint sought compensation for the woman's serious injuries, which included tears in the labrum of both hips and damage to her spine and neck. Following the fall, she was placed into induced labor and required surgical treatment and extensive rehabilitation. She was confined to rehabilitation services for several months and underwent surgery to repair the hip tears.

The injuries significantly limited the woman's ability to perform daily living activities such as walking, bending, and sitting. She could not complete regular household chores, sit or stand for long periods, or enjoy her usual activities with her children. The building owner and managing agent argued that the fall occurred during a period of snow and cold-weather precipitation, and they were not required to cover all floors with mats or continuously remove moisture tracked onto the stairs. They also claimed they did not create the wet conditions and lacked notice of them.

"We were prepared to call medical and economic experts to demonstrate to the jury the extent of this lovely woman's injuries and the effect they have had, and will continue to have, on her life," said Monier, who has represented accident and injury victims for over 25 years. "When an accident happens as a result of someone's negligence or failure to use reasonable care, the injured party deserves to be fully compensated not only for what that person has gone through since the date of the accident, but also for what the person will go through in the future, for the rest of that person's life."

Monier added that the settlement proceeds will help the client deal with her continuing pain and functional difficulties. This case underscores the importance of holding property owners accountable for maintaining safe premises and ensuring that victims of negligence receive fair compensation for their injuries and ongoing needs.
